Because of the Policing and Crime Act 2017, the police, fire and rescue, and emergency ambulance services now
have a duty to collaborate. Already, there are many examples of collaboration, which include:
– Co-location for command and control, HQ, back office functions;
– Capital resource rationalisations, such as fleet, buildings, and equipment; and
– Shared back-office services (legal, procurement, HR, finance, etc.).
However, while it is recognised that successful blue light collaboration faces various obstacles, taxation is frequently overlooked or disregarded.
The taxation obstacles – VAT, employment taxes, SDLT and (to a lesser extent, corporate taxes) – cannot be managed retrospectively and must be considered at the earliest stages of any planned collaboration project or arrangement. Too often, the taxation consequences are ignored, assumed to be neutral or given attention only belatedly and by non-specialists.
This seminar will address the potential VAT issues around blue light collaboration.
There are three main factors behind most issues:
– the different VAT regimes that govern Ambulance Trusts and Police and Fire bodies:
– assumptions about previous VAT treatment continuing unchanged in collaboration projects; and
– a general misunderstanding about the ongoing VAT compliance and efficiency requirements for public bodies.
VAT must be considered as an integral part of planning for blue light collaboration; the consequences for neglect can jeopardise collaboration projects or significantly increase their costs.
